Comstock Township, MI — Comstock Township Attorney Robert Thall has formally requested that the Michigan Attorney General and the Kalamazoo County Prosecutor’s Office review the legal authority and eligibility of Comstock Township Superintendent Scott Hess through a potential Writ of Quo Warranto proceeding.

The request seeks clarification from the appropriate legal authorities regarding whether Superintendent Hess currently meets all statutory requirements to hold office. According to the request, several issues have been raised for review, including:

Whether a valid and properly executed oath of office is on file as required by law

Whether applicable residency requirements for the position are being satisfied

Whether the structure and terms of the current employment contract may create legal or statutory conflicts affecting eligibility or authority to serve

Attorney Thall’s request does not constitute a final legal determination. Instead, it asks the Attorney General and Prosecutor’s Office to evaluate whether grounds exist to initiate formal quo warranto proceedings, which are used in Michigan to challenge an individual’s legal right to hold public office.

No findings have been made by any court or reviewing authority at this time.
