Comstock Township, MI — A major legal battle is brewing in Comstock Charter Township over the use of taxpayer funds. A resident has filed an emergency lawsuit in the Kalamazoo County Circuit Court against Comstock Charter Township and its Board of Trustees.
The lawsuit, detailed in court documents, aims to block a massive, unverified separation payout to former Township Superintendent Scott Hess.
The Core Allegations:
The Payout: While Hess’s standard employment agreement only dictates a nine-month severance package, reports and a series of investigative articles by FAFO Justice reveal the serious legal issues surrounding the Superintendent holding office legally. The final separation package may exceed a staggering $412,000.
Lack of Transparency: Plaintiff Dena O’Connor alleges the Township has failed to provide any contract amendments, board resolutions, or legal justifications to authorize the ballooned expenditure.
The Stakes: The lawsuit asserts that if these public funds are disbursed before a judicial review, recovering the money for Township taxpayers may be “difficult, delayed… or impossible.”
The plaintiff is a private citizen and is not seeking personal monetary damages. The sole intent of the filing is to preserve public funds and enforce transparency under Michigan law.
A formal court hearing has been officially scheduled for August 1, 2026, at 8:15 a.m. before the Honorable Curtis J. Bell.
