BATTLE CREEK, MI — The City of Battle Creek has issued a brief and non-specific response to mounting questions regarding allegations that city employees have been directed to remove or avoid sharing media coverage related to former Michigan State Police trooper Kris Douponce.
The inquiry, submitted by FAFO Justice earlier this week, sought clarification on multiple constitutional concerns—including potential restrictions on employee free speech, possible monitoring of social media activity, and whether any disciplinary actions were being threatened against employees for engaging with or sharing protected content outside of work hours.
In response, City Manager Amanda E. Zimmerlin declined to directly address any of the specific questions raised.
“The City does not comment on or discuss personnel matters with the public,” Zimmerlin wrote. “The City remains committed to operating in accordance with all applicable laws and to maintaining appropriate confidentiality regarding employment-related matters.”
The City’s response does not confirm or deny whether any directives—formal or informal—have been issued to employees regarding media engagement or social media activity tied to Douponce-related reporting. It also leaves unanswered whether the City has engaged in any monitoring of employee accounts or communications with Douponce or his affiliated business interests.
The lack of specificity is likely to raise further concerns among transparency advocates and constitutional scholars, particularly given the serious implications surrounding potential restrictions on off-duty speech by public employees. Courts have consistently held that government employees retain First Amendment protections when speaking as private citizens on matters of public concern—subject to limited exceptions.
At the center of the controversy is ongoing investigative reporting into Kris Douponce, whose alleged activities have drawn increasing public scrutiny.
