{"id":573,"date":"2026-06-19T10:27:03","date_gmt":"2026-06-19T14:27:03","guid":{"rendered":"https:\/\/fafojustice.com\/?p=573"},"modified":"2026-06-19T10:27:04","modified_gmt":"2026-06-19T14:27:04","slug":"the-accountability-avoidance-scheme-battle-creek-invents-outsourced-oversight-to-protect-its-ownwashington-heights-juvenile-stop","status":"publish","type":"post","link":"https:\/\/fafojustice.com\/?p=573","title":{"rendered":"THE ACCOUNTABILITY AVOIDANCE SCHEME: Battle Creek Invents \u201cOutsourced Oversight\u201d to Protect Its Own:Washington Heights Juvenile Stop"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>When a Police Department\u2019s Own Policies Raise Questions, The City Doesn\u2019t Get to Outsource Accountability to the Citizens<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By Autumn Smith<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Battle Creek Police Department has spent years telling the public that policies, training, and accountability matter.But when a juvenile in Washington Heights was detained, handcuffed, searched, and arrested under circumstances now being publicly questioned, the response from city leadership was not immediate accountability.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Instead, Mayor Mark Behnke essentially asked the public to decide whether policies were violated. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Let that sink in.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The City of Battle Creek has a police department. The City has supervisors. The City has command staff. The City has a policy manual. The City has an internal review process. So why is the public being asked to play investigator?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Why is the question not: <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><em>\u201cDid our officers follow department policy, and if not, what corrective action is required?\u201d <\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Why is it: <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><em>\u201cTell us if you think they violated policy\u201d?<\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">That is not accountability. That is outsourcing accountability. And the irony is this: the policies already answer the questions:<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781874252853-1024x683.png\" alt=\"\" class=\"wp-image-575\" srcset=\"https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781874252853-1024x683.png 1024w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781874252853-300x200.png 300w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781874252853-768x512.png 768w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781874252853.png 1264w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>BCPD POLICY 420 \u2014 CONTACTS AND TEMPORARY DETENTIONS<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">This is where the entire incident begins. Before you can search someone, handcuff someone, or arrest someone, the first question is: Was the initial detention lawful?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">BCPD Policy 420 exists specifically to answer that. The policy recognizes officers can have consensual encounters with citizens. But the moment a person is no longer free to leave, the constitutional standard changes.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A detention requires:- reasonable suspicion- based on articulable facts- connecting the person to possible criminal activity Not:- a hunch- a feeling- curiosity- \u201csomething seemed off\u201d- stereotypes- assumptions. The policy requires facts. Actual facts. The officer must be able to explain: \u201cWhat specific facts made you believe this individual was involved in criminal activity?\u201d <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Not: \u201cBecause he looked suspicious.\u201dNot:\u201cBecause he was in a certain neighborhood.\u201d Not:\u201cBecause he touched his waistband.\u201d Those things alone do not automatically create reasonable suspicion. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Policy 420 also states: A person shall not be detained longer than reasonably necessary to resolve the officer\u2019s suspicion. Meaning: A temporary investigation cannot become a fishing expedition.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>POLICY 312 \u2014 SEARCH AND SEIZURE:<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">This is the Fourth Amendment policy. The policy that governs searches of people, property, vehicles, and evidence. BCPD\u2019s own language recognizes: The Fourth Amendment protects citizens from unreasonable searches and seizures. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Officers generally need:- a warrant- probable cause- lawful justification. Probable cause is not a guess. It is not a hunch. It requires a reasonable belief based on reliable information that evidence of a crime is probably present. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Policy 312 specifically requires searches to be:- constitutional- limited in scope- limited in time and area- connected to the legal justification. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Translation: A legal stop is not a blank check.A person being detained does not automatically become searchable. A police officer cannot say: \u201cI stopped you, therefore I can search you.\u201d <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>That is not how the Constitution works.<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>THE WAISTBAND QUESTION<\/strong>:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The department\u2019s own policies require a deeper question:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Was there a legitimate safety concern supported by facts? Policy 420 allows a pat-down only when there are specific reasons to believe a person may be armed and dangerous. A frisk is not:- evidence gathering- a general search- a way to find something illegal. It is a safety measure.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The question is: Was there a specific, articulable reason to believe this juvenile was armed? Or was an assumption made?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Because assumptions are exactly what constitutional protections are designed to prevent.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>POLICY 302 \u2014 HANDCUFFING AND RESTRAINTS<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">This is where the escalation matters.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">BCPD Policy 302 makes clear:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Handcuffs are not a punishment. They are not a compliance tool. They are not a way to show authority. The policy states restraints should not be used to:- punish- intimidate- display authority That matters. Because being detained is not the same thing as being arrested.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Policy 302 specifically addresses detainees. A person can be temporarily detained and later released without arrest. But restraints must:- be reasonably necessary- continue only as long as justified- be balanced against the intrusion on the person <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The question is simple:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Even if the stop was justified \u2014 was handcuffing this minor justified? Was there an actual safety concern? Or was the restraint itself an unnecessary escalation?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>THE POLICY VIOLATION CHECKLIST<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The public does not have to rewrite the rules. BCPD already wrote them. The questions are: Policy 420:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">1. What were the specific articulable facts?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">2. What crime was suspected?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">3. How was this individual connected to that suspected crime?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">4. Was the detention longer than necessary? <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>Policy 312<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">1. What legal authority justified the search?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">2. Was there probable cause?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">3. Was consent voluntary?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">4. Was the search limited?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>Policy 302<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">1. Why were restraints used?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">2. What safety concern existed?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">3. Was the juvenile treated as a detainee or as someone already convicted?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">4. Were restraints removed when no longer necessary?<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>AND THEN THERE IS THE MOST IMPORTANT POLICY:<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong><em>Courtesy, Dignity, and Respect.<\/em><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">BCPD\u2019s own standards require officers to: safeguard rights- protect people from intimidation- enforce the law courteously- act without personal bias- treat people with dignity and respect. This is not about being \u201csoft on crime.\u201d This is about constitutional policing. A department can enforce laws and still respect the people it serves. Those two things are supposed to happen together.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"864\" src=\"https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781877559771-1024x864.png\" alt=\"\" class=\"wp-image-576\" srcset=\"https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781877559771-1024x864.png 1024w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781877559771-300x253.png 300w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781877559771-768x648.png 768w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/06\/1781877559771.png 1119w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>THE BIGGER ISSUE: WHO HOLDS THE CITY ACCOUNTABLE?<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The City of Battle Creek cannot simultaneously claim: \u201cWe have policies.\u201dand \u201cWe need the public to tell us if they were violated.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">That is not leadership. That is a failure of oversight. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The city has the authority to review. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The city has the ability to investigate. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The city has the responsibility to enforce its own standards. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The public\u2019s role is not to replace internal accountability. The public\u2019s role is to demand it. Because policies mean nothing if they only exist on paper. A policy manual sitting on a shelf is not accountability. A policy manual enforced equally \u2014 that is accountability.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Battle Creek citizens deserve answers. Not excuses. Not deflection.
