And more importantly, it does not exist to protect public officials from the consequences of gross negligence, willful misconduct, or outright violations of law.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">That distinction matters, because the pattern of behavior alleged against Battle Creek Police Chief Shannon Bagley\u2014combined with statements made on the public record\u2014raises a serious question: Is this protected discretion\u2026 or unprotected misconduct?<\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\"><strong>What Governmental Immunity Actually Covers (and What It Doesn\u2019t)<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Michigan law generally shields government employees from liability when they are performing discretionary acts within the scope of their authority. But that protection collapses under two key conditions: Gross negligence \u2014 conduct so reckless it demonstrates a substantial lack of concern for whether injury results. Willful or wanton misconduct \/ illegal acts \u2014 actions that go beyond poor judgment into knowing violations of law or duty. Even Michigan legal guidance makes clear that immunity disappears when conduct crosses that line, especially where actions are the direct and primary cause of harm or involve reckless disregard for legal obligations . Basically: You can be wrong and still be protected.You cannot be reckless, dishonest, or lawless and hide behind immunity.<\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\"><strong>The CJIS \/ Signal Admission: A Bright-Line Problem<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">At a June 2025 public meeting, I told the commission at public comment that the chief himself\u2014Bagley\u2014admitted to releasing <a href=\"https:\/\/www.fbi.gov\/services\/cjis\" target=\"_blank\" rel=\"noopener\" title=\"CJIS-protected law enforcement information\"><strong>CJIS-protected law enforcement information<\/strong><\/a> over the <a href=\"https:\/\/www.bbc.com\/news\/articles\/c1kjd091019o\" target=\"_blank\" rel=\"noopener\" title=\"Signal messaging app\"><strong>Signal messaging app<\/strong><\/a>. That\u2019s not a gray area. CJIS (Criminal Justice Information Services) rules are governed by strict federal standards. Unauthorized dissemination\u2014even through encrypted apps\u2014can constitute<strong>:<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u2022Policy violations<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u2022Security breaches<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u2022Potential federal compliance issues<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Knowingly bypassing CJIS protocols is not a discretionary policing decision. It\u2019s a rules violation. wp-block-paragraph\"><strong>Pattern Matters: Not a One-Off Mistake<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">One allegation alone might be defensible as error. But what\u2019s being described is a pattern of behavior: Dismissing or minimizing serious criminal allegations including a reported multi-jurisdictional sextortion ring. Publicly asserting limitations on jurisdiction that contradict standard law enforcement cooperation practices-as an excuse to not investigate the <a href=\"https:\/\/fafojustice.com\/?p=16\" target=\"_blank\" rel=\"noopener\" title=\"multi-jurisdictional sextortion ring\"><strong>multi-jurisdictional sextortion ring<\/strong><\/a>. Ignoring or deflecting accountability concerns raised by the public. Allegedly mishandling protected law enforcement data-CJIS<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Even in the summarized <a href=\"https:\/\/citizenportal.ai\/articles\/6182325\/Battle-Creek-City\/Calhoun-County\/Michigan\/Resident-alleges-CJIS-violation-by-police-chief-urges-commission-to-direct-investigation\">public record<\/a>, residents described \u201cno discipline, no investigation, no accountability\u201d following these concerns. That pattern is what creates legal exposure. Because courts don\u2019t just look at isolated acts\u2014they look at whether an official\u2019s behavior shows: Reckless disregard for duties, systematic failure to act, intentional avoidance of enforcement obligations.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">That\u2019s where immunity starts to erode.<\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\"><strong>Dereliction, Misconduct, and Possible Obstruction<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Based on the behavior described, three legal theories come into play:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">1. <strong><a href=\"https:\/\/battlecreekmi.gov\/DocumentCenter\/View\/7692\/Policy-320\" target=\"_blank\" rel=\"noopener\" title=\"Dereliction of Duty\">Dereliction of Duty<\/a><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Failing to act where there is a clear obligation\u2014especially in serious criminal matters\u2014can qualify as neglect of official responsibilities. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><em>Policy 320.5.7 EFFICIENCY<br>a. Neglect of duty.<br>b. Unsatisfactory work performance including, but not limited to, failure, incompetence, inefficiency<br>or delay in performing and\/or carrying out proper orders, work assignments or the instructions of<br>supervisors without a reasonable and bona fide excuse.<\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">2. <strong><a href=\"https:\/\/www.legislature.mi.gov\/Laws\/MCL?objectName=MCL-750-505\" target=\"_blank\" rel=\"noopener\" title=\"Misconduct in Office MCL 750.505\">Misconduct in Office MCL 750.505<\/a><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In Michigan, this is a common-law felony involving:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Corrupt behavior<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Abuse of authority<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Failure to perform a legal duty<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A police chief is not just another employee\u2014they are the final policymaker for law enforcement operations. That raises the stakes significantly.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">3. <strong><a href=\"https:\/\/www.law.cornell.edu\/wex\/obstruction_of_justice\" target=\"_blank\" rel=\"noopener\" title=\"Obstruction of Justice (Potentially)\">Obstruction of Justice (Potentially)<\/a><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">If actions go beyond inaction and into:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Suppression of investigations<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Misrepresentation of jurisdictional authority<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Interference with reporting or evidence handling\u2026then the exposure escalates further.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"559\" src=\"https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/04\/govimmunty3-1024x559.png\" alt=\"\" class=\"wp-image-232\" srcset=\"https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/04\/govimmunty3-1024x559.png 1024w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/04\/govimmunty3-300x164.png 300w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/04\/govimmunty3-768x419.png 768w, https:\/\/fafojustice.com\/wp-content\/uploads\/2026\/04\/govimmunty3.png 1408w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\"><strong>You Don\u2019t Get Immunity for&nbsp; Lying or Being Incompetent<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">This is the uncomfortable reality for city leadership: If the chief knowingly made false statements about jurisdiction, data handling, or enforcement authority &#8211; <strong>that\u2019s misconduct.<\/strong> If the chief doesn\u2019t understand those fundamentals \u2192<strong> that\u2019s gross incompetence<\/strong>. <strong>Neither is protected<\/strong>. Governmental immunity is not a safety net for: Ignoring federal data security rules (CJIS), Misstating basic law enforcement authority, Failing to act on serious criminal conduct.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">It exists to protect good-faith decision-making, not institutional failure.<\/p>\n\n\n\n<p class=\"has-large-font-size wp-block-paragraph\"><strong>The Bigger Risk: Liability Shifts to the \u201cCity\u201d (You The Taxpayer)<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Here\u2019s what often gets overlooked-When a chief acts as a final decision-maker, their conduct can expose the municipality itself to liability under federal civil rights law<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/1983\" target=\"_blank\" rel=\"noopener\" title=\" (42 U.S.C. \u00a71983).\"> (42 U.S.C. \u00a71983).<\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">And unlike individual immunity, municipal liability: <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Does not get the same protections. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Can attach to policies, customs, or deliberate indifference.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">That means if this behavior is proven to be tolerated or systemic, the legal risk doesn\u2019t stop with one person\u2014<strong>it lands on the entire city.<\/strong> Governmental immunity is not a magic phrase that makes problems disappear. If the allegations and admissions are accurate, the issue isn\u2019t whether Chief Bagley is protected\u2014it\u2019s whether his conduct: <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Crosses into gross negligence.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Constitutes misconduct in office. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Or reflects deliberate indifference to legal duties.
